What obligations do staffing agencies have?

Article 58, Paragraph 1 of the Labor Contract Law:Human resource dispatchA company is the employer as defined in this law and must fulfill all responsibilities of the employer to the worker. The main contents include the following:


(1) Responsibilities for signing labor contracts with dispatched employees and responsibilities for dispatching: Article 58, Paragraph 2 of the Labor Contract Law: Human resources dispatch companies shall sign fixed-term labor contracts of more than 2 years with dispatched workers and pay monthly remuneration; For dispatched workers who have no working period, the human resources dispatch company shall pay them monthly labor remuneration according to the minimum wage standard set by the local people's government.


(2) Responsibility of Reporting:Human resource dispatchThe company should inform dispatched employees of the employing unit's basic information, job arrangements, labor rules and regulations, as well as promised safety and hygiene, working hours, rest and vacation, wages and benefits, and provide guidance on labor laws, policies, rights protection methods, and related business handling. Article 60, Paragraph 1 of the Labor Contract Law: The dispatch agency shall inform the dispatched worker of the contents of the dispatch agreement.

(3) Responsibility for providing and managing personnel file services: This is an additional responsibility for workers after being dispatched, which the human resources dispatch company must fulfill to ensure the protection of workers' interests.


(4) Responsibility for paying wages and social insurance premiums on behalf of others: Article 60, Paragraphs 2 and 3 of the Labor Contract Law: Human resources dispatch companies must not withhold the employer's provisions according to regulationsHuman resource dispatchThe agreement pays the wages of the dispatched laborer. Human resources dispatch companies and employers must not charge the dispatched workers fees.
